Terms of Service

The agreement between you and Script Monitoring, Inc. for using the platform.
LEGAL
Privacy
Terms
These terms govern your use of Script Monitoring, the script monitoring platform operated by Script Monitoring, Inc. ("Script Monitoring", "we", "us"). By creating an account or using the service you agree to them on behalf of yourself and the organisation you represent ("you").
Last updated: October 2, 2026

1. The service

Script Monitoring inventories the scripts that run on the pages you choose, checks them against the versions you approved, detects changes to those pages and their security headers, can block scripts you tell it to, and produces evidence for PCI DSS requirements 6.4.3 and 11.6.1. You install it by adding our tag to your pages.
We may improve, change or retire features over time. If a change materially reduces what a paid plan includes, we will tell you in advance and you may cancel.

2. Your account

Give us accurate details and keep them current.
Keep your login credentials secure. You are responsible for activity under your account, including by people you invite to it.
Tell us promptly at [email protected] if you suspect unauthorised access.
You must be able to enter a binding contract, and the service is for business use.

3. How you may use it

We grant you a non-exclusive, non-transferable right to use the service for your internal business purposes while your account is active. You may install the tag only on websites you own or are authorised to monitor.
You must not:
copy, resell, sublicense or offer the service to third parties as your own;
reverse engineer the service or our tag, except where the law allows it regardless of this restriction;
probe, overload or interfere with the service, or bypass its limits or security;
use the service to monitor sites without authorisation, or for anything unlawful.

4. Your data and our role

You own the data you bring to the service and the telemetry our tag records on your pages. You give us the right to process it only to provide, secure and support the service for you.
For telemetry from your pages we act as your processor. Our tag records information about scripts, not about visitors, and does not store values people type into your forms. Our Privacy Policy explains how we handle personal data, and a Data Processing Agreement is available on request.
You are responsible for having the right to deploy the tag on your pages and for any notices your own visitors need.

5. Plans, billing and renewal

Free plan. Includes 1,000 page views a month with no payment details required. We may change or end the free plan with reasonable notice.
Paid plans. Billed monthly or annually in advance through our payment processor, Stripe. Annual billing is charged at ten months for twelve.
Usage. Page views are the only metered unit. Page views above your plan's allowance are billed in arrears at the overage rate shown on our pricing page.
Renewal. Paid plans renew automatically for the same period unless you cancel before the renewal date. Cancellation takes effect at the end of the current period.
Refunds. Fees already paid are not refunded for partial periods, unless the law requires otherwise or these terms say so.
Price changes. We will give you at least 30 days' notice before a price change, and it applies from your next billing period.
Late payment. If a payment fails and is not resolved after we notify you, we may suspend paid features until it is.
Prices exclude taxes, which are added where required.

6. What the service does and does not promise

The service helps you detect and control the scripts on your pages. It cannot guarantee that every malicious or unauthorised script will be detected or blocked, and it does not by itself make you compliant with PCI DSS or any other standard. Your assessor decides compliance.
The tag is designed to fail open: if our service is unreachable, your pages and checkout keep working. Enterprise plans include a 99.9% uptime commitment; other plans are provided without an uptime commitment.

7. Confidentiality

Each of us will protect the other's non-public business information with at least reasonable care, use it only for the purposes of this agreement, and share it only with people who need it and are bound to keep it confidential. This does not apply to information that is public, already known, independently developed, or that must be disclosed by law, in which case the disclosing party will give notice where it lawfully can.

8. Intellectual property and feedback

We own the service, the tag, our software, documentation and brand. Nothing in these terms transfers them to you.
If you send us suggestions or feedback, we may use them without restriction or payment.
We may use your organisation's name and logo to identify you as a customer, for example on our website and in sales materials. If you would rather we did not, write to us at [email protected] and we will stop.

9. Disclaimers

Except as expressly stated in these terms, the service is provided "as is" and "as available". To the extent the law allows, we disclaim all other warranties, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the extent the law allows:
neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data;
each party's total liability under these terms is limited to the fees you paid us in the twelve months before the event giving rise to the claim, or USD 100 if you are on the free plan.
These limits do not apply to fraud, wilful misconduct, your payment obligations, or liability that cannot be limited by law.

11. Indemnities

You will defend and compensate us for third-party claims arising from your misuse of the service, your breach of these terms, or deploying the tag on sites you were not authorised to monitor.
We will defend and compensate you for third-party claims that the service, used as permitted, infringes their intellectual property. If that happens we may modify the service, obtain the right for you to keep using it, or end the affected part and refund any prepaid fees for it.

12. Suspension and termination

You can close your account at any time from the dashboard.
We may suspend access if your use threatens the security or stability of the service, or if payment is overdue, and will restore it once the issue is resolved.
Either party may terminate if the other materially breaches these terms and does not fix it within 30 days of notice.
We may end the service for convenience with 60 days' notice and refund any prepaid fees for the unused period.
When your account closes, your data is deleted as described in our Privacy Policy. Sections that by their nature should survive, including confidentiality, liability and indemnities, continue after termination.

13. Changes to these terms

We may update these terms. If a change is material, we will notify you by email or in the dashboard at least 30 days before it takes effect. Continuing to use the service after that date means you accept the updated terms.

14. Law and disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Before starting formal proceedings, both parties will try in good faith for 30 days to resolve the dispute by talking to each other. Any proceedings will be brought in the state or federal courts located in Delaware, and both parties submit to their jurisdiction.

15. General

Entire agreement. These terms, together with any order form or plan you sign up for and our Privacy Policy, are the whole agreement between us on this subject.
Signed agreements. If you have signed a separate agreement or order form with us, that agreement takes precedence over these terms where they conflict.
Assignment. You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets, with notice to you.
Events beyond control. Neither party is liable for delays caused by events beyond its reasonable control.
Severability and waiver. If part of these terms is unenforceable, the rest still applies. Not enforcing a right now does not waive it.
Notices. We send notices to the email address on your account. Send notices to us at [email protected].
